This website (“Website”) is owned and operated by Agree, LLC, a limited liability company (“Agree”).  At Agree, we appreciate the trust you have placed in us. Your privacy and security are our top priorities. This Privacy Policy explains what information we collect and how we use it, and under what circumstances we may disclose the information to third parties.  This Privacy Policy applies to all visitors to our Website and anyone else who accesses or uses our products and services. WHEN YOU ACCESS OUR WEBSITE, YOU AGREE TO THIS PRIVACY POLICY.  IF YOU DO NOT AGREE TO THIS PRIVACY POLICY, OR TO ANY CHANGES WE MAY SUBSEQUENTLY MAKE, IMMEDIATELY STOP ACCESSING OUR WEBSITE AND OUR SERVICES.  This policy may change from time to time (see Changes to Our Privacy Policy below).  Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Information We Collect and How We Collect It

Information You Provide to Us.

Whether you are a Contract Creator or a Client, we collect information about you only when we reasonably believe it is necessary to administer our business and provide our products and services to you.

We do not collect personally identifiable information from you when you simply visit our Website.  If you are a Contract Creator and wish to create a contract or wish to obtain payment services, you will need to set up an account with us.  If you are a Client of a Contract Creator, we will set us a user account for you based upon the information provided to us by your Contract Creator.  As part of that process, we will create the account using your personally identifiable information (“Account Information”), such as your name, address, e-mail address, and if our payments services will be used, information associated with your bank account and/or payment method (credit card number and expiration date or bank account information), as applicable. In order to verify that our Contract Creators are legitimate businesses and to satisfy the requirements of our payments processor, we also request additional information about you and your business on the Sub-merchant Application which may include personally identifiable information about you.  Once your account has been established, we may collect transaction and experience information, such as information necessary to complete any transactions with us, as well as information about our communications with you.  We need this information to provide the products and services that you request from us and to let you know of additional products and services about which you might be interested.

Information We Collect through Automatic Data Collection Technologies.

We automatically collect certain non-personally identifiable information when you visit our Website through automatic data collection technologies, such as the following:

Log data:  Our servers automatically record information when you use our Website, such as your IP address, the type of browser you are using and its settings, the third party website you visited immediately prior to accessing our Website, the operating system you are using, the domain name of your Internet service provider, the search terms you use on our Website, the specific Website pages you visit, and the duration of your visits.

Cookie data:  We use “cookies” to obtain certain types of information when your web browser accesses our Website.  "Cookies" are small text files that we transfer to your computer's hard drive or your Web browser memory to enable our systems to recognize your browser and to provide convenience and other features to you, such as recognizing you as a frequent user of our Website. Some of the cookies we use are associated with your account with us (including personal information about you), and other cookies are not.

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. No one under age 13 may provide any information to or on the Website. We do not knowingly collect personal information from children under 13. Using and Sharing Your Information

We use your personally identifiable information to administer your records, account and funds; to comply with certain applicable laws and regulations; and to help us design and enhance our product and service offerings so that we may provide you with quality products, services and superior customer support.  In particular, we use your Account Information to create your Account Dashboard.  Additionally, we may use your information or share your information with third parties:

- To fulfill any other purpose for which you provide it.
- To provide you with notices about your account, including expiration and renewal notices.
- To verify your identity and the existence of your business where applicable.
- To complete a purchase or transaction.
- To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

- To send you promotional materials about our co-promotional partners that we think you might be interested in.

We may use non-personally identifiable information we collect to generate statistics on our customer activity including transaction patterns, but these research initiatives will never include any personally identifiable information without your authorized consent.

By using our services to conduct payment transactions or process registrations, you consent to our sharing your Account Information with our business partners and affiliates as necessary to complete your payment transaction or process your registration, or to provide you the services you have registered for. In order to do so, we use the information you provide for the following purposes:

- Provide the services and customer support you request
- Process transactions and send notices about your transaction
- Provide you with automatic payments processing
- Identify your service preferences

Additional Information Concerning our Third Party Providers and Business Partners.  We may disclose your Account Information with our business partners that to facilitate your order or transaction. We also may furnish your Account Information to third party providers to process transactions.  All of these companies act on our behalf and are obligated to keep the information confidential and use it to provide only the services we have asked them to perform. For example, in order to serve you most efficiently, payment transactions are handled by established third-party banking and processing agents. When we transfer our assets.  As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all (or substantially all) of our assets, the personally identifiable information and non-personally identifiable information we have about you will be transferred to and used by this acquiring entity. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Where required by law.  We reserve the right to disclose any personally identifiable or non-personally identifiable information about you if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Website, or other customers; or (d) in an emergency to protect the health and safety of our Website's customers or the general public.

Your Choices About Your Account and Information

Your Account Information.  Our goal is to provide you with simple and meaningful choices about how your information is used.  As a Contract Creator, you control your choices by your selections when you set up your account with us, and by updating your profile page as described below.  As a Client, you control the information in your user account by notifying us at We do retain non-personally identifiable information concerning use of our Services.  For example, we retain non-personally identifiable data concerning the number, frequency, size and purpose of transactions.

Promotional Offers. If you do not wish to have your contact information used by us to promote our own or third parties' products or services, you can opt-out by send us an e-mail stating your request to If we have sent you a promotional e-mail, you may unsubscribe at the “unsubscribe link” in the email. This opt out does not apply to information provided to the Company as a result of services for which you have registered, your service experience, or other transactions.  Account Information will be retained in our database and maintained for future orders or transactions and as required under applicable law, rules, and/or regulations.  It is your responsibility to ensure that your Account Information is accurate.

Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by send us an e-mail stating your request to For this opt-out to function, you must have your browser set to accept browser cookies. We do not control third parties' collection or use of your information to serve interest-based advertising. Nevertheless, these third parties may provide you with ways to choose not to have your information collected or used in this way. Do Not Track Option

To protect your privacy and to comply with federal regulations, we will need to verify your identity before you update or review your Account Information. If the Account Information cannot be verified or authenticated, Agree may terminate the transaction and you may be prohibited from accessing or using the Services or Website. A limited amount of transaction history may also be available to you at your request.

How We Use Email

We will email you (only as necessary) to respond to your questions or instructions, to provide you updates on this Privacy Policy or our Terms of Use, to process your payments, alert you of messages, and send you payment receipts. We (or our co-promotion partners) may send you promotions and news about the services you use or other products and services we think may be of interest to you.  Aside from the foregoing, we will not contact you about any other matters, unless you specifically request it.  For example, we may email you when

- you request a particular service or sign up for a feature that involves email communications,
- it relates to our products and services that you use (e.g., product updates, customer support, etc.), or
- you consented to being contacted by email for a particular purpose.

You may unsubscribe from receiving future commercial email communications from us by clicking the "unsubscribe" link included at the bottom of any marketing emails we send.  However, we reserve the right to send you transactional emails such as customer service communications in connection with the products you have purchased.

Closing your account

If at any time you choose to discontinue your use of our services, you should notify us and we will deactivate your account.  Any data concerning your past transactions or account activity will no longer be available to you and will be stored in a secure manner. We are legally required to maintain a backup copy of such transaction data for 13 months after the transaction was completed. We do not control how our partners retain, store and destroy data that they have obtained access to from in connection with completing your transactions or your use of our services. Your California Privacy Rights

Residents of the State of California, under certain provisions of the California Civil Code, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain personally identifiable information, as defined under California law during the preceding year for third party direct marketing purposes.  You are limited to one request per calendar year. We may offer chat rooms, blogs, message boards, bulletin boards, or similar public forums where you and other users of our Website can communicate. The protections described in this Privacy Policy do not apply when you provide information (including personally identifiable information) in connection with your use of these public forums.  We may use personally identifiable and non-personally identifiable information about you to identify you with a posting in a public forum.  Any information you share in a public forum is public information and may be seen or collected by anyone, including third parties that do not adhere to our Privacy Policy. We are not responsible for events arising from the distribution of any information you choose to publicly post or share through our Website.

Data Security Measures

We administrative, technical and physical security measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration and disclosure. When we collect or transmit sensitive information such as a credit or debit card number, or bank account information, we use industry standard methods to protect that information.  Personal information you provide to us by email may not be secure, and we do not recommend you email us any personal information.  is stored on our secure servers behind firewalls.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. "Phishing" is a scam designed to steal your personal information. If you receive an e-mail that looks like it is from us asking you for your personal information, do not respond. We will never request your password, username, credit card information, or other personal information through e-mail.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website.
